FBI agent accused of multiple rapes acquitted of attempted murder charges in 2019

Eduardo Valdivia, a 40-year-old FBI agent from Gaithersburg, Maryland, has been arrested and charged with multiple counts of sexual assault, specifically two counts of second-degree rape, four counts of fourth-degree sexual offense, and four counts of second-degree assault. Two women have come forward alleging they were raped inside a tattoo studio operated by Valdivia under an alias. Police believe there may be additional victims. The women were lured in through an Instagram page devoted to the tattoo business operated by Valdivia. The first woman was offered a free tattoo in exchange for modeling work, and when she returned for a second shoot, she was sexually assaulted. The second victim also met Valdivia through the same Instagram account.

Valdivia had previously been acquitted of attempted murder in late 2022 for a shooting that took place on a Metro train in Bethesda, Maryland. He claimed self-defense in the shooting, where he shot a man from 2 to 3 feet away after an interaction that began with a fist bump. The man asked Valdivia for money, and after Valdivia refused, the man approached and was shot after being told to back up multiple times.

Valdivia is currently being held without bond, and the FBI has confirmed they are cooperating with the police investigation. The agency has suspended Valdivia pending the investigation. The FBI takes allegations of criminal violations seriously and is working with law enforcement authorities to address the matter.
