Arkansas Court Dismisses Complaint Against Choctaw Nation-Backed Anti-Casino Referendum Signatures


The Arkansas Supreme Court recently rejected a legal challenge to a ballot measure that could impact the licensing of Cherokee Nation Entertainment’s planned Legends Resort and Casino in Pope County. The measure would amend the constitution to only allow the Arkansas Racing Commission to grant gaming licenses. Despite the court’s decision, the challenge to the ballot language is still pending.

Cherokee Nation Businesses CEO Chuck Garrett has reported that a campaign is already underway to persuade Arkansas voters to reject the ballot question. The referendum stems from a dispute over the 2018 amendment allowing casinos in certain counties, including Pope County, where voters rejected the amendment.

The Local Voters in Charge committee, supported by the Choctaw Nation, collected over 160,000 signatures to put the referendum on the ballot. The court decision left the total valid signatures well above the required number. Both sides have launched ad campaigns, with the Choctaw Nation contributing millions to the Local Voters in Charge committee.

The Arkansas Canvassing Compliance Committee has raised concerns about the impact of the referendum on jobs and tax revenue, accusing out-of-state billionaires of trying to manipulate the constitution for their own interests. The committee is waiting for the court’s decision on the ballot title challenge.

The final decision regarding the ballot language is still pending, and voters are set to have their say in November. Supporters of Issue 2 argue for local voter control, while opponents warn of potential job losses and revenue cuts if the referendum is passed. The high-stakes battle over the future of casino licensing in Arkansas continues as the election approaches.
