Arkansas grants charities the right to not place children with homosexual couples


Arkansas Governor Sarah Huckabee Sanders signed a bill last Thursday, known as Act 509 or the Keep Kids First Act, that prohibits state officials from forcing faith-based adoption and foster care organizations to place children in homes that go against the agency’s religious or moral beliefs. The law also prevents the government from taking action against adoptive or foster parents based on their religious beliefs or their refusal to support government policies on sexual orientation or gender identity.

Supporters of the law, including the Alliance Defending Freedom, argue that every child deserves a loving home and that the legislation prioritizes the well-being of children by allowing faith-based organizations to participate in the adoption and foster care process without facing discrimination. However, critics such as the Arkansas chapter of the ACLU argue that the bill would codify discrimination against LGBTQ individuals and couples seeking to foster or adopt.

The legislation comes in the wake of a Supreme Court ruling in 2021 that officials in Philadelphia could not exclude Catholic Social Services from its foster program solely because the organization refused to place children with same-sex couples. The court’s decision in Fulton v. City of Philadelphia emphasized the importance of government neutrality and respect for religious beliefs in the adoption and foster care system.

The debate over whether faith-based organizations should be required to adhere to antidiscrimination laws regarding gender identity and sexual orientation continues to be a contentious issue in the field of adoption and foster care.
