Hearing on Menendez Brothers’ Parole Suitability Rescheduled for Late Summer

The hearing that could potentially lead to the freedom of Erik and Lyle Menendez, convicted in the 1989 murders of their parents, has been postponed from June 13 to August 21 and 22, according to California corrections officials. The postponement follows a judge’s decision on May 13 that resentenced the brothers, making them eligible for parole after having originally been sentenced to life without the possibility of parole.

The Menendez brothers, now 54 and 57, have maintained that their actions were driven by a desire to escape abuse from their father, a claim supported by their attorney, Mark Geragos. Following the resentencing, the Board of Parole Hearings decided to convert an existing clemency hearing into an initial parole suitability hearing but faced objections from victims’ family members, prompting the rescheduling. The brothers’ clemency application with California Governor Gavin Newsom remains active.

In August, the parole commissioners will assess whether the Menendez brothers pose an unreasonable risk to the community if released. Input from prosecutors, victims’ relatives, and other relevant parties will be considered during these hearings. The Menendez brothers are currently held at the Richard J. Donovan Correctional Facility in San Diego County. The Los Angeles County District Attorney Nathan Hochman has opposed their resentencing, arguing that the brothers have not fully accepted responsibility for their actions. Contrarily, the brothers asserted they have taken full responsibility and provided no justification for their parents’ murders. This case continues to garner significant attention as it raises complex discussions about justice, accountability, and the impact of past trauma.
